The Square Dental Clinic Terms of Use

Article 1 (Purpose)

The purpose of these Terms of Use is to set forth the rights, obligations, and responsibilities of The Square Dental Clinic (hereinafter referred to as the “Clinic”) and its members, and other matters necessary for the use of services, in connection with the use of The Square Dental Clinic website (hereinafter referred to as the “Website”) provided by the Clinic, in compliance with the Framework Act on Telecommunications, the Telecommunications Business Act, the Personal Information Protection Act, and the Enforcement Decrees thereof.

Article 2 (Definitions)

  • 1.

    “Services” means all Website-related services available to Members, regardless of the device on which they are implemented (including various wired and wireless devices such as PCs, TVs, and mobile devices).

    2.

    “Member” means a person who has agreed to these Terms of Use and the use of personal information on the Clinic's Website and who uses the Services provided by the Clinic.

    3.

    “ID” means a combination of letters and numbers selected by the Member and approved by the Clinic for the identification of the Member and the use of the Services.

    4.

    “Password” means a combination of letters or numbers selected by the Member to confirm that the Member is the person matching the assigned ID and to protect the Member's confidentiality.

    5.

    “Posts” means writings, photos, videos, various files, links, and the like in the form of information such as symbols, characters, voice, sound, images, and video posted by a Member on the Services while using the Services.

Article 3 (Posting and Amendment of the Terms of Use)

  • 1.

    These Terms of Use take effect upon being posted on the Website, and the Clinic may amend these Terms of Use to the extent that such amendment does not violate relevant laws and regulations.

    2.

    When the Clinic amends these Terms of Use, it shall specify the effective date and the reasons for the amendment and announce them on the Website, together with the current Terms of Use, in the manner described in the preceding paragraph from 7 days prior to the effective date of the amended Terms of Use until the effective date.

    3.

    If a Member does not agree to the application of the amended Terms of Use, the Clinic may not apply the amended Terms of Use to that Member, and in this case the Member may terminate the service agreement.

    4.

    In the case of the preceding paragraph, the Clinic may terminate the service agreement if it determines that it is impossible to continue providing the Services to the Member under the existing Terms of Use alone.

Article 4 (Interpretation of the Terms of Use)

Matters not stipulated in these Terms of Use and the interpretation thereof shall be governed by relevant laws and regulations or commercial practice.

Article 5 (Conclusion of the Service Agreement)

  • 1.

    The service agreement is concluded when a person who wishes to become a Member (hereinafter referred to as an “Applicant”) agrees to these Terms of Use, applies for membership, and the Clinic accepts the application.

    2.

    In principle, the Clinic accepts an Applicant's application for use of the Services. However, the Clinic may refuse to accept, or may subsequently terminate the service agreement for, any of the following applications:

    - If the Applicant has previously lost membership under these Terms of Use, unless the Clinic has approved the Applicant's re-registration
    - If the application is not made under the Applicant's real name or uses another person's name
    - If false information is provided or information requested by the Clinic is omitted
    - If a child under the age of 14 applies without the consent of a legal representative (such as a parent)
    - If approval is impossible due to reasons attributable to the Applicant, or if the application otherwise violates the provisions of these Terms of Use

Article 6 (Obligation to Protect Personal Information)

  • 1.

    The Clinic endeavors to protect Members' personal information in accordance with relevant laws such as the Information and Communications Network Act and the Personal Information Protection Act.

    2.

    The relevant laws and the Clinic's Privacy Policy apply to the protection and use of personal information. However, the Clinic's Privacy Policy does not apply to linked sites other than the Clinic's official website.

Article 7 (Notices to Members)

  • 1.

    Unless otherwise specified in these Terms of Use, when the Clinic gives notice to a Member, it may do so to the email address or other contact information provided by the Member when concluding the service agreement.

    2.

    The Clinic may replace the notice described in the preceding paragraph by posting it on the Clinic's notice board for 7 days or more.

Article 8 (Obligations of Members)

  • 1.

    Members shall not engage in any of the following acts:

    - Registering false information when applying or making changes
    - Stealing another person's information
    - Altering information posted by the Clinic
    - Transmitting or posting information (such as computer programs) other than information permitted by the Clinic
    - Infringing on the copyrights or other intellectual property rights of the Clinic or any third party
    - Damaging the reputation of, or interfering with the business of, the Clinic or any third party
    - Disclosing or posting obscene or violent messages, images, audio, or other information contrary to public order and morals on the Services
    - Using the Services for commercial purposes without the consent of the Clinic
    - Any other illegal or unjust acts
    2.

    Members shall comply with relevant laws and regulations, the provisions of these Terms of Use, usage guidelines, precautions announced in connection with the use of the Services, and matters notified by the Clinic, and shall not engage in any other acts that interfere with the Clinic's business.

Article 9 (Obligations of the Clinic)

  • 1.

    The Clinic shall not engage in any acts prohibited by relevant laws and these Terms of Use or contrary to good morals, and shall make its best efforts to provide the Services continuously and stably.

    2.

    The Clinic shall have a security system in place to protect personal information (including credit information) so that Members can use the Services safely, and shall publish and comply with its Privacy Policy.

    3.

    If the Clinic recognizes that an opinion or complaint raised by a Member in connection with the use of the Services is justified, it shall endeavor to address it. The Clinic will inform the Member of the handling process and results of the opinion or complaint by email or through the registered contact information.

Article 10 (Provision and Change of Services)

  • 1.

    The Clinic provides the following services:

    - Appointment booking services provided through the Website
    - Online consultation services provided through the Website
    - Medical information services provided through the Website
    - Other services determined by the Clinic
    2.

    In principle, the Services are provided 24 hours a day, 365 days a year.

    3.

    The Clinic may temporarily suspend the provision of the Services in the event of maintenance, inspection, replacement, or failure of information and communications equipment such as computers, interruption of communications, or other significant operational reasons. In this case, the Clinic will notify Members in the manner set forth in Article 7. However, if there are unavoidable reasons that prevent the Clinic from giving prior notice, it may give notice afterwards.

    4.

    The Clinic may conduct regular maintenance if necessary for the provision of the Services, and the regular maintenance time shall be as announced on the service screen.

    5.

    If there are significant reasons, the Clinic may change the content of the Services provided according to operational or technical needs.

    6.

    The Clinic may modify, suspend, or change the content of services provided free of charge as required by the Clinic's policies and operations, and unless otherwise specifically provided by relevant laws, the Clinic shall not provide separate compensation to Members for such changes.

Article 11 (Service Fees)

  • 1.

    The Services are available free of charge to all persons registered as Members.

    2.

    If the Clinic decides to charge fees for the Services, it shall announce the timing, policy, and cost of such fees on the Services before the fees take effect.

Article 12 (Appointment Booking Service)

  • 1.

    Members may use the appointment booking service through the Website if they wish.

    2.

    All Members shall act in good faith with respect to appointments booked in advance.

    3.

    Except in cases of intentional misconduct or gross negligence, the Clinic shall not bear any civil or criminal liability for any losses that may occur during a Member's use of the appointment booking service.

Article 13 (Online Consultation Service)

  • 1.

    The online consultation service cannot, under any circumstances, replace actual medical practice such as in-person examination, diagnosis, or surgery.

    2.

    The Clinic makes its best efforts to maintain security so that the content of Members' consultations is not disclosed to any third party other than the consulting dentist and the service administrator. However, the Clinic shall not be liable for the disclosure or loss of consultation content in any of the following cases:

    - If the Member's password is leaked due to the Member's negligence
    - If the Member uses the “Delete Consultation” function
    - In the event of natural disasters or other force majeure
    3.

    The content of consultations conducted on the Website may be used for the following purposes in a form that does not identify any specific individual:

    - Statistics and academic activities
    - Where specifically provided by law
    - Use in FAQs and as basic data deemed necessary for the operation of the Clinic
    4.

    Answers to consultations are subjective responses based on the medical knowledge of each specialist and do not represent the opinion of the Clinic's Services.

    5.

    The Clinic may not provide some or all of the consultation service if a consultation is requested with any of the following content:

    - If the same Member repeatedly requests a consultation with the same content
    - If a consultation is requested using expressions contrary to common sense
    - If a consultation is requested asking for a diagnosis
    - If a consultation is requested regarding treatment costs, examination costs, drug prices, etc.
    - If a question is asked to confirm information received from another medical institution
    - If a medical institution or its staff is slandered (insulted) or defamed without reason

Article 14 (Medical Information Service)

  • 1.

    The content provided on the Services is general and summary in nature and is provided for informational purposes only. Information or consultations provided on the Services can never replace a medical diagnosis. Information or consultations provided on the Services are not intended to replace medical diagnosis, examination, or treatment. If you have any questions or concerns about your health, you should see a qualified medical professional for a diagnosis. Under no circumstances should you disregard medical advice or delay seeking diagnosis, examination, or treatment because of information provided on the Services.

    2.

    The Clinic does not recommend any specific tests, products, or treatments mentioned on the Services. All personal opinions expressed on the Services are those of their respective authors.

    3.

    Accepting the information on the Services, or the opinions of specialists participating in the Services or of other Members or visitors using the Services, is entirely at the user's own discretion. Accordingly, the Clinic shall not be liable for any damage, injury, or other disadvantage arising from the use of any product, information, idea, or instruction provided to Members.

Article 15 (Ownership of Copyright)

  • 1.

    Copyrights and other intellectual property rights to works created by the Clinic belong to the Clinic.

    2.

    Members shall not use, or allow third parties to use, information obtained through the Website for commercial purposes by modification, reproduction, public transmission (broadcasting), publication, distribution, exhibition, or any other means without the prior consent of the Clinic.

Article 16 (Management of Posts)

  • 1.

    If a Member's Post contains content that violates relevant laws such as the Information and Communications Network Act and the Copyright Act, the rights holder may request suspension of posting or deletion of the Post in accordance with the procedures set forth by the relevant laws, and the Clinic shall take action in accordance with the relevant laws.

    2.

    Even without a request from the rights holder under the preceding paragraph, the Clinic may take temporary measures regarding the Post in accordance with its policies and relevant laws if there are grounds to recognize an infringement of rights or if the Post otherwise violates the Clinic's policies or relevant laws.

Article 17 (Cancellation and Termination of Agreement)

  • 1.

    Members may apply to terminate the service agreement at any time through the information management menu on the initial service screen, and the Clinic shall process such application immediately in accordance with relevant laws.

    2.

    When a Member terminates the agreement, all of the Member's data will be deleted immediately upon termination, except where the Clinic retains member information in accordance with relevant laws and the Privacy Policy.

    3.

    When a Member terminates the agreement, Posts written by the Member, Posts reposted by others, and Posts registered on public boards will not be deleted. Please delete them before canceling your membership.

    4.

    The Clinic may terminate the service agreement without prior notice, or suspend the use of the Services for a specified period, if a Member engages in any of the following acts:

    - Acts contrary to public order and good morals
    - Acts related to criminal activity
    - Planning or carrying out the use of the Services for the purpose of undermining the national interest or the public good
    - Stealing another person's ID and password
    - Damaging another person's reputation or causing disadvantage to others
    - The same user registering twice with different IDs
    - Interfering with the sound use of the Services, such as by causing harm to the Services
    - Other violations of relevant laws or the terms of use set by the Clinic

Article 18 (Limitation of Liability)

  • 1.

    The Clinic shall be exempt from liability for the provision of the Services if it is unable to provide the Services due to natural disasters or equivalent force majeure.

    2.

    The Clinic shall not be liable for any disruption in the use of the Services caused by reasons attributable to the Member.

    3.

    The Clinic shall not be liable for the reliability, accuracy, or other aspects of information, materials, or facts posted by Members in connection with the Services.

    4.

    The Clinic shall be exempt from liability for any transactions made between Members, or between Members and third parties, through the Services.

    5.

    Unless otherwise specifically provided by relevant laws, the Clinic shall not be liable in connection with the use of services provided free of charge.

Article 19 (Dispute Resolution and Jurisdiction)

  • 1.

    Disputes regarding any matters related to the use of the Services that are not stipulated in these Terms of Use shall be resolved by mutual agreement to the greatest extent possible.

    2.

    If a lawsuit is filed regarding a dispute arising from the use of the Services, the Seoul Central District Court shall have exclusive jurisdiction as the court of first instance.

[Addendum]

These Terms of Use apply from June 10, 2022 until new Terms of Use are issued.
